Texas Central Railroad & Infrastructure, Inc. filed suit against a landowner in Harris County seeking permission to survey the landowner’s property as part of the bullet train project. State District Judge Joseph Halbach recently denied a motion for summary judgment filed by TCR&I on the bullet train’s power to condemn and set the case for trial on July 3, 2017. While the ruling doesn’t completely derail the proposed high speed rail, it does mean that a jury will be permitted to consider issues regarding the bullet train’s power to condemn.
