Lawmakers ask Texas Supreme Court to Rehear Eminent Domain Case for High-Speed Rail Project

Eleven Texas lawmakers this week filed an Amicus Curiae Letter requesting a review of the eminent domain case of James Fredrick Miles v. Texas Central Railroad & Infrastructure, Inc. and Integrated Texas Logistics, Inc. for the proposed Texas High-Speed Rail Project.

The group of lawmakers are requesting the Texas Supreme Court to rehear the case based on Texas Central Railroad & Infrastructure, Inc. and Integrated Texas Logistics, Inc. not meeting the definition of a railroad company or an interurban electric railway company, which is necessary to have the right to exercise the power of eminent domain. The project would connect Houston to Dallas / Fort Worth, with a stop in the Brazos Valley, and use eminent domain to acquire property from Texas landowners for the rail line.
